Selected 80 acres at Christmas Hills in 1865 and is believed to have been the first land-owner in Sutton. Burgess died in the bush just off Buttermans Track; his decomposed body was found by Mr and Mrs Love. Burgess died intestate but he had two brothers, one named George, and two married sisters, Caroline and Fanny, who lived in NSW. An inquest was held in September 1892 in which it is stated that he once said he had a son living in NSW.
